Question 2: Marriage Equality

Constitutional amendment to repeal the inactive ban on same-sex marriage and affirm equal marriage rights.

1In 60 seconds

Should Virginia's constitution be amended to remove the 2006 ban on same-sex marriage, affirm that two adults may marry regardless of sex, gender, or race, and require all legally valid marriages to be treated equally under the law?

2What it means for your block

This measure appears on every ballot in Virginia on November 3, 2026. Same-sex marriage has been legal nationwide since Obergefell v. Hodges (2015), but Virginia's constitution still contains the 2006 ban — unenforceable today, but active again if the U.S. Supreme Court reverses course. A Yes vote repeals that text and affirms equal marriage rights; a No vote leaves the inactive ban in the constitution.

3The main sides

  • Supporters (Yes vote): Say Virginia's constitution should reflect equal rights and love, removing an outdated ban so marriage rights remain protected in Virginia regardless of future federal court decisions.
  • Opponents (No vote): Argue marriage should remain defined between a man and a woman, express concerns regarding religious freedom protections for those with traditional beliefs, or dispute constitutional wording.

Stated fairly. CivicLoop is nonpartisan and does not endorse either side.
